Making It Work Mediation What is mediation? Mediation is a voluntary process which parties commit to at the beginning of the mediation session. It is a more economical way of solving disputes while keeping the decision making and outcome in the hands of participants. It is a confidential, voluntary process that is scheduled at your convenience.

What is the role of the mediator? As a mediator I am a neutral party committed to helping participants communicate effectively, open and honestly in a safe environment. I offer a free half hour phone consultation which will help you decide if mediation is right for you.

What are the benefits of going to mediation rather than a lawyer and court? Court costs and lawyers fees make a very large dent in your pocket book. The outcome of your situation is left up to the court to decide which takes the decision making completely out of your hands. Issues with mediation are resolved within weeks where as court may go on for several years. Mediators hourly rates are typically half that of a lawyers and eliminate court costs.

What is the time frame for mediation? Every situation is different. A Conflict can be resolved in 2-3 two hour sessions or may take a few more depending on the number of issues to be resolved. This all depends on the co-operation and commitment of the participants

Do I have to be in the same room with someone I am having a dispute with? There are several types of mediation. If someone feels unsafe we have what is called “Shuttle mediation”. This is where we meet with the parties individually and make a mutually acceptable agreement without ever having to be in the same room with the other person.

What if the mediation session becomes very emotional? At anytime during the mediation if the conversation becomes emotional parties may request a break, whether it be coffee, a brief walk or bathroom break. This helps to collect thoughts and settle our emotions.

The mediator may also suggest a caucus. Sometimes a caucus is required if either of the parties are feeling frustrated or feel that they are not being heard or just very upset with the conversation. A caucus is a short time with each individual one on one with the mediator. This gives the participant opportunity to share things that they are uncomfortable sharing with the other party present or to just regroup and collect their thoughts. This conversation is not shared unless agreed upon by the individual sharing.

If parties are unable to reach a mutually acceptable agreement, they are free to go on and pursue other avenues. What if mediation does not work?
